What changes the number in Maine

If you were partly at fault

Maine uses modified comparative fault with a 50 percent bar. You can recover damages only if you are less at fault than the other driver. If the jury finds you equally at fault or more at fault, you get nothing.

“If such claimant is found by the jury to be equally at fault, the claimant may not recover.”

The other driver's policy limit is the ceiling

Maine drivers must carry at least $50,000 in liability coverage per person, $100,000 per crash, and $25,000 for property damage.

“For injury to or death of any one person, $50,000”

29-A M.R.S. 1605(1)(C)(2)

If the other driver has no insurance

Maine requires uninsured and underinsured motorist coverage equal to your liability limits, unless you reject that equal amount in writing.

“the amount of coverage to be so provided may not be less than the amount of coverage for liability for bodily injury or death...unless the purchaser expressly rejects such an amount”

24-A M.R.S. 2902(2)

The deadline that ends the claim

You have 6 years to sue for injuries from a car crash in Maine.

“All civil actions shall be commenced within 6 years after the cause of action accrues and not afterwards”

14 M.R.S. 752

What a lawyer takes if you hire one

A contingency fee agreement in Maine must be in writing, signed by the client, and state how the fee is calculated.

“A fee may be contingent on the outcome of the matter for which the service is rendered, except in a matter in which a contingent fee is prohibited by paragraph (d) or other law.”
