How to get a car accident report in West Virginia

The short answer
You can request a West Virginia State Police crash report by mail, fax, or email using the WVSP Criminal and Crash Report Request form. A standard mailed crash report costs $20. You must immediately report a crash to police if anyone is hurt or killed, or if the total property damage looks like $1,000 or more.
Which agency has your report
The report comes from the agency whose officer came to the crash. On interstates and state highways that is usually the state police or highway patrol. On city streets it is the city police, and outside city limits it is often the county sheriff. Ask the officer for the report number before you leave the scene.

Your reporting duties
When you must report to police
You must immediately report a crash to police if anyone is hurt or killed, or if the total property damage looks like $1,000 or more.

Whether you must file your own report
West Virginia does not require the driver to separately file a written accident report with the DMV. The responding officer files the crash report, and it is sent to the Division of Highways so the state can check that you had insurance.
