What changes the number in Montana
If you were partly at fault
Montana uses modified comparative negligence with a bar at 51 percent. You can recover damages if your share of fault is not greater than the other driver's, but your award is reduced by your percentage of fault. If your fault is greater than the other driver's, you recover nothing.

The other driver's policy limit is the ceiling
Montana's minimum liability insurance limits are $25,000 per person and $50,000 per accident for injury or death, plus $20,000 for property damage.

If the other driver has no insurance
Montana insurers must include uninsured motorist coverage on your auto policy unless you reject it in writing.
