Do I need a lawyer after a car accident in Chicago?

The short answer
Chicago is in Cook County, so a crash lawsuit from Chicago is filed in the Circuit Court of Cook County, whose Civil Division at the Daley Center hears Chicago claims under $30,000. Illinois lets you bring a claim of $10,000 or less yourself as a small claim. Before any of that, the insurer will want the Chicago crash report, and if your car was towed the storage bill is growing while you decide. Nobody who is paid to take your case can tell you honestly whether you need one, so this page shows you the three things that actually decide it: what your own paperwork says, what Illinois does about fault, and how much time is left.
Before you call anyone, get the report
Every insurer and every lawyer will ask for the crash report first. It is the document that says who the officer believed caused it. In Chicago you get it here.
Where your report comes from
Chicago police sell the crash report from their own portal at crash.chicagopolice.org, where you search by the RD number from your crash, a driver name, or the crash date.

How long you wait for it
Crash information takes about a day to appear. The department says it can take up to 24 hours for the state to assign the report a control number and for the information to be available.

Whose name is on it
The Chicago Police Department works crashes on the city streets inside Chicago. Call 911 if someone is hurt, or 311 when the crash is not an emergency.
The bill that grows while you decide
Towing and storage in Chicago
A car towed after a Chicago crash goes to a city auto pound. Call 311 or search your plate on the city vehicle search to find it. The city tow fee is $250 for a car under 8,000 pounds, plus $50 a day storage.

Storage is charged by the day, and an impound lot can sell a car that nobody claims. That clock runs whether or not anyone has admitted fault, so deal with the car first and argue about blame after.

A small claim you file yourself costs a filing fee and an afternoon. A claim worth more than the small claims limit, or one where you are hurt, is the kind people bring a lawyer into. Neither choice is ours to make for you.
How fault changes what you get
If you were partly at fault
Illinois uses modified comparative fault with a 51 percent bar. You can collect money only if your share of fault is 50 percent or less. If your fault is more than 50 percent, you cannot collect anything.

How injury lawyers charge in Illinois
Contingency fee rules
Illinois has no statute or rule capping the percentage a lawyer can charge in a personal injury contingency fee. The lawyer conduct rule only requires that the fee be reasonable and be put in a signed written agreement, and it bans contingent fees only in divorce cases and criminal defense.

A contingent fee agreement shall be in a writing signed by the client and shall state the method by which the fee is to be determined”

Other Illinois rules that can change what you get
- If a Chicago vehicle or a road defect was involved
If a state owned vehicle or state road is involved, you must file a written notice with the Illinois Attorney General and the Court of Claims within 1 year of the crash, and the claim itself must also be filed within 1 year. If a city, county or other local government is involved, there is no separate notice step, but the lawsuit itself must be filed within 1 year of the crash.
