What changes the number in Florida

If you were partly at fault

If you are more than half at fault for your own injuries, you cannot recover any damages from the other driver. If you are fifty percent or less at fault, your damages are reduced by your share of the fault.

The other driver's policy limit is the ceiling

Florida requires drivers to carry at least $10,000 in personal injury protection and $10,000 in property damage liability coverage. Bodily injury liability coverage is not required for most drivers, though it is required for taxis and some other drivers.

If the other driver has no insurance

Insurance companies selling bodily injury liability policies in Florida must include uninsured motorist coverage, unless the policyholder rejects it in writing.

“No motor vehicle liability insurance policy which provides bodily injury liability coverage shall be delivered or issued for delivery in this state...unless uninsured motor vehicle coverage is provided therein”

You have 2 years to sue over injuries from a car crash.

What a lawyer takes if you hire one

Florida sets a sliding scale of presumed reasonable contingency fees for injury cases. Before the defendant files an answer, the presumed limit is a third of the first $1 million recovered, 30 percent of the next million, and 20 percent above that. The limit rises to 40 percent of the first $1 million if the case settles after an answer is filed.
